How We Collect Information About You

We collect personal information and general information about you directly from you when you provide it to us, such as by creating an account, emailing us, or making a purchase directly with us. We may also ask you for personal information when you report a problem with the Platform. We also collect personal information from other websites or social media account pages you have previously visited or visit after

using our Platform, such as by tracking whether you click on a link to a third-party site posted on our  Platform, for purposes of better meeting your needs and preferences in advance. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

We may also collect certain personal information from third parties, provided that you have authorized those third parties to share information with us, for example, through our social media pages hosted on third-party social media platforms, or when you use third party services such as PayPal or Afterpay to make a purchase for you or in connection with your purchase.

We also collect certain general information about you and information about your internet connection as you navigate through and interact with the Platform. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies. The technologies we use for this automatic data collection, and the types of information  collected by these technologies, may include:

  • Log Files and Web Beacons. These are scripts or other files (also known as "tags" or "pixels")  we use to track actions occurring on the Platform related to your connection or usage. The use of these files on the Platform may potentially result in the retention of personal information by thirdparties that manage these log files, beacons, or tags.
  • Analytics. Analytics are web analysis services provided by PostHog. These services utilize personal information collected to track and examine the use of the Platform, to prepare reports on its activities, and to share them with other services. Analytics services may use the personal information collected to contextualize and personalize the ads of its own advertising network. We may use Google Analytics to automatically collect information about your connection to and usage of the Platform.
  • Hosting or Displaying Third Party Services or Content. Certain key components of the  Platform are hosted or run using Third Party Services including Vercel, Payload, Accessibee,  Stripe and Shopify. These allow the Platform to be presented to you as a unified website. Such services provide a wide range of tools to the Platform (such as analytics, user registration, commenting, database management, e-commerce, payment processing) that imply the collection and handling of personal information. In addition, we may display content owned or published by third parties on external platforms. This allows you to view and interact with this third-party content directly from the Platform. This type of service might still collect web traffic data for the pages where the service is installed, even when users do not use it.
  • Browser Cookies and Cookie Pop-Ups. A cookie is a small file sent to your internet browser and stored on your computer or device when you access our Platform. Our Platform uses cookies to track user traffic, improve functionality, and support marketing activities. Our Platform may use third-party advertising cookies (e.g., Google Ads, Meta) to deliver personalized advertisements. Users can opt out of such cookies through our cookie consent pop-up or browser settings. In compliance with privacy regulations such as GDPR and CCPA, we provide a cookie consent pop-up when you first visit our Platform. This pop-up allows you to:
    • Accept all cookies
    • Reject non-essential cookies
    • Customize your cookie preferences (e.g., enable only necessary cookies while disabling  analytics and marketing cookies)

You may also refuse to accept browser cookies by activating the appropriate setting in your browser.  However, if you disable essential cookies, certain parts of the Platform may not function properly. Unless you adjust your preferences or browser settings to refuse cookies, our system will issue them automatically when you visit the Platform. To learn more about cookies and how to manage them, please visit www.allaboutcookies.org

We do not alter these collection practices when we see a Do Not Track signal from your browser because there is currently no uniform industry standard for recognizing and responding to DNT signals.

The Platform may also contain links to other sites (a "third-party link"). If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the privacy policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services presented to you via the Platform.

This technical data may include IP address and browser user agent, request paths, methods (e.g., GET, POST), and timestamps, unique request identifiers for debugging purposes, and metadata about middleware and function execution during your session. Vercel retains server runtime logs for up to three days, after which they are automatically deleted unless configured otherwise. For more information, see Vercel's privacy policy.

Mailchimp implements appropriate technical and organizational measures to safeguard your data and prevent unauthorized access. For more information, see Mailchimp's privacy policy.

We also use Payload, our internal content management and analytics platform, to monitor Platform performance and analyze aggregated user behavior. Payload may process basic engagement metrics (such as number of users viewing content, interaction patterns), technical diagnostics for site stability and feature usage, and aggregated statistics for ad impressions and clicks. Payload retains visitor tracking data for up to thirty days for deduplication purposes. Payload may retain historical analytics indefinitely,  unless you request deletion as provided in this Privacy Policy. Payload retains visitor identifiers in your browser's local storage for up to 365 days, unless you clear these identifiers by closing your browser. All data Payload retains is hashed and anonymized to protect user privacy and cannot be used to identify individual users. For more information, see Payload's privacy policy.

Your Privacy Rights And Choices

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with control over the visibility of your personal information, which you can access by emailing us at connect@thesetset.com. The rights that you may have when exercising  your data privacy choices, depending on the jurisdiction in which you reside, may include:

  • Accessing, correcting, updating, or requesting deletion of your information (also called  "portability" of your information).
  • Anonymizing your personal information by providing us with a "pseudonym" or other identifying information which is not personal to you.
  • Objecting to processing of your information, asking us to restrict processing of your information, or requesting the portability of your information.
  • Opting out from receiving marketing communications that we send you at any time, or from any actions on our part that may constitute a "sale" of your personal information. You can exercise this right by selecting the "unsubscribe" or "opt-out" link in the marketing communications we send you, or by adjusting your browser’s cookie preferences. Additionally, if you have the ability to create an account on our site and have done so, you may update your email preferences by changing the settings in your account.
  • Withdrawing your consent at any time if we have collected and processed your information with your consent. Withdrawing your consent will not affect the lawfulness of any processing that we conducted prior to your withdrawal, nor will it affect processing of your information conducted in reliance on lawful processing grounds other than consent.
  • Complaining to a data protection authority about our collection and use of your information. For more information, please contact your local data protection authority.

You may also use your mobile device, computer, or other internet-connected device’s settings to change how your device retains and uses information provided or collected by applications such as the Platform operating on that device. We encourage you to familiarize yourself with your device’s and browser’s settings before contacting us with a request to modify or delete any of your personal information.

Depending on the jurisdiction of your residence, some or all of these rights may not apply to you. In  addition, these rights are not absolute, and your request to exercise certain data privacy rights may be  denied by us based on applicable law, including when denial of access is required or authorized by law;  when granting access would have a negative impact on other people’s privacy; when necessary to protect

our rights and properties; when your request would result in incomplete or inaccurate information otherwise necessary for us to provide you with products or services; or when your request is frivolous or overly burdensome.

We respond to all requests that we receive from individuals who wish to exercise their data protection rights in accordance with applicable law. You can contact us with your request by sending an email to  connect@thesetset.com. U.S. State Privacy Notice

In addition to the rights provided above, you may have certain additional rights with respect to your personal information, as described in this U.S. State Privacy Notice (this "Notice"). The terms of this  Notice may apply to "consumers", "natural persons", or other similarly situated individuals as identified  by terms defined under privacy laws enacted in one or more U.S. States, including, without limitation, in  California, Colorado, Connecticut, Florida, Oregon, Utah, and Virginia (collectively, "U.S. State Privacy Laws"). This Notice is a supplement to our other policies or notices for visitors to our Platform,  including, without limitation, our Privacy Policy and our Terms of Use.

This Notice applies to you only if you and/or we meet an applicable definition set forth in one or more U.S. State Privacy Laws which would have the effect of granting you or us certain rights with respect to your personal information or data pursuant to a given U.S. State Privacy Law. For example, if you do not meet the definition of a "consumer" or an "individual" under a U.S. State Privacy  Law, or if we do not meet the definition of a "business" or a "controller" under the same U.S. State  Privacy Law, this Notice does not apply to you or to us. This Notice also does not apply to your personal information or data that is not treated as "personal information", "personally identifiable information",  "personal data", or a similar term defined or referred to in one or more U.S. State Privacy Laws. This  Notice also does not apply to information collected by third-party content, Platforms, applications,  platform, code (e.g., plug-ins, APIs, and software development kits), and certain cookies and other tracking technologies; our collection and use of information through such means is covered by our  Privacy Policy. Finally, where we provide our products and services to you on behalf of an institution or other third party, we process your personal information as a ‘service provider’ or ‘processor’ in accordance with our contractual agreements with that third party. In that case, the third party’s privacy notice governs the use of your personal information. In all, this Notice only reflects how we collect, use,  disclose, and otherwise process personal information for our own purposes (e.g., for our Platforms and marketing), when we are acting as a ‘business’ or ‘controller’ under a U.S. State Privacy Law, and only if you are considered a ‘consumer’ or an ‘individual’ under that same U.S. State Privacy Law.

This Notice is designed to provide you with notice of our data practices on our Platform and anywhere this Notice is posted over the period of time from the date on which our Privacy Policy was last updated to today, as required under some U.S. State Privacy Laws. Additionally, this Notice applies to our current data practices such that it is meant to provide you with "notice at collection," which is notice of personal information we collect, and the purposes for which we process personal information, among other things as required by the U.S. State Privacy Laws. For any new or substantially different processing activities that are not described in this Notice, we will notify you as legally required, such as at the point of collection. We reserve the right to amend this Notice at our discretion and at any time. When we make changes to this Notice, we will update its effective date (which will be the date that our Privacy Policy was last updated). In the event of a conflict between any other policy, statement, or notice set forth by us and the terms of this Notice, this Notice will prevail to the extent that its terms apply to your and our rights pursuant to a U.S. State Privacy Law. To the extent the terms of this Notice are not inconsistent with the terms of any other policy, statement, or notice set forth by us, the terms of those policies, statements, or notices are incorporated herein by this reference. Certain terms used herein and not otherwise defined will have the meaning ascribed to them in our Privacy Policy.

We collect personal information from you as described in more detail in our Privacy Policy. Please refer to the sections of our Privacy Policy entitled Kinds Of Personal Information We Collect, Using And  Disclosing Your Personal Information, How We Use Technology To Collect And Use Personal  Information, and Marketing And Your Personal for more information on how we collect and use your personal information for purposes of U.S. State Privacy Laws.

Some of the categories of personal information we collect may be classified as "sensitive" under certain  U.S. State Privacy Laws, including health, biometric, and disability information (e.g., to allow us to appropriately accommodate the needs of users of our Platform or who purchase products or services from us). We use this sensitive information only for the purposes described in our Privacy Policy or as disclosed by you at the time of collection, and only to the extent necessary to operate our Platform and provide our products and services, to enter into and perform a contract with you, to comply with legal and regulatory requirements or as otherwise permissible for our own internal purposes consistent with laws.

As described in more detail in our Privacy Policy and our Terms of Use, how we use and disclose your personal information depends on your relationship with us. Please refer to our Privacy Policy and Terms of Use for more information on how we use and disclose any personal information we collect from you.

We do not sell your personal information for profit; however, we may sell or license aggregated,  anonymized data to third parties. This data does not contain any personal information and cannot be used to identify individual users. However, we may engage in targeted advertising on our own websites (but not in our products), which may be considered a "sale" under certain U.S. State Privacy Laws. In this context, as is common practice among companies that operate online, we may permit third party advertising networks, social media companies and other third-party businesses to collect information directly from your browser or device through cookies or similar tracking technology when you visit or interact with our Platform or otherwise engage with us online. For example, they may collect information about your internet connection or your device, browsing history and Platform usage, location data; and they may make inferences generated from this information and you interactions with our services as well as other sites and services. These third parties use this personal information to deliver targeted advertising  (also known as "cross-context behavioral advertising") and personalized content to you on our Platform,  on other sites and services you may use, and across other devices you may use, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research. To learn more,  please see our Privacy Policy regarding how we use cookies on our Platform. If our use of your personal information is covered by this paragraph, you may also have the right to request that we disclose to you the categories of your personal information that is sold, and the categories of third parties who buy such information. Even if you have previously given us your consent to sell your personal information to third parties, you have the right to direct us not to sell your personal information at any time.

During the preceding 12 months, we have collected, used, and shared the categories of personal information described in this Privacy Policy. We do not sell the personal information of consumers we know to be less than 18 years of age or use or share such information for targeted advertising purposes.

Depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to limit or opt-out of the sale of personal information or the processing of personal information for purposes of targeted advertising (as described in the Your Privacy Rights section below).

Depending on your state of residency and the applicability of a U.S. State Privacy Law to you and us, and subject to certain legal limitations, you may be able to exercise some or all of the privacy rights described in our Privacy Policy.

If you would like to exercise your rights under this Notice or our Privacy Policy, please see the section entitled Your Privacy Rights And Choices. Once we receive your request, we may verify it by requesting information sufficient to confirm your identity, including by asking you for additional information.  Consistent with applicable law, if you choose to exercise your rights, we will not charge you different prices, provide different quality of services, or discriminate against you in any way for exercising your rights, unless those differences are permitted by law. If you would like to use an agent registered with your state of residence pursuant to a U.S. State Privacy Law or other applicable law to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.  Depending on your state of residence, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted via email to:  connect@thesetset.com.

In addition to the rights provided above, if you are a California resident, you may have some additional rights as described in this section. For example, California Civil Code Section 1798.83 permits users of the Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
